ESG Rule Continues to Confuse

401k FiduciaryESG Rule makers are having a difficult time landing on a final decision.  After years of volleying among different branches of government, it is obvious that agreement and harmony around the ESG Rule are not around the corner.  As of January 26, 2023,  25 states, have filed suit in an attempt to prevent the most current version of the Rule from taking effect.  The arguments center around claims that the Rule undermines protections for retirement plan participants while also overstepping the DOL’s authority under ERISA!
